Not necessarily. A commercial airliner is not “public property”; it belongs to the airline corporation. The interior of the aircraft is not public space like a sidewalk or a park. When you purchase a ticket, you are required to abide by the rules. At minimum, this woman is in violation of any no-photo/recording policies the airline company has in place. Airlines have more power on planes because as private parties they are not bound by the First Amendment as is the US government. The airport itself would be considered public space but not the aircraft. The airline would have been well within its rights to throw this woman off the plane… maybe not while it is airborne, but still…
